If you do not agree, you may not use the website or any of our Services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that enables us to offer products and services to you.

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission.

Certain products may be available exclusively online. These products may have limited quantities and are subject to our Return & Refund Policy.
We strive to display products and images accurately but cannot guarantee that your device’s display of color or detail is exact.
We reserve the right to limit sales of our products to any person, region, or jurisdiction, and to discontinue any product at any time.

6. HVAC Product Disclaimers

All HVAC equipment sold through HomeHeatCentral must be installed and serviced in accordance with manufacturer specifications and applicable local codes. Certain products may be designed for homeowner or DIY installation as specified by the manufacturer. We are not responsible for product performance, safety, or warranty issues arising from improper installation, handling, or use.
Warranty coverage is provided solely by the manufacturer, and claims should be filed directly with them. We do not provide additional warranties beyond those offered by the manufacturer.
Improper installation or unauthorized modifications void return eligibility and manufacturer warranty.

7. Shipping and LTL Deliveries

Freight and LTL shipments are curbside delivery only unless otherwise stated. Risk of loss transfers to the customer once the carrier accepts the shipment. Customers are responsible for inspecting deliveries upon arrival and noting any visible damage before signing.

8. Accuracy of Billing and Account Information

We reserve the right to refuse any order placed with us. We may limit or cancel orders at our discretion, including those that appear to be placed by dealers or resellers.
You agree to provide current, complete, and accurate purchase and account information for all purchases and to promptly update your account details, including payment and contact information.

9. Third-Party Tools and Links

We may provide access to third-party tools or links to third-party websites. These are provided “as is” without warranties or control. We are not responsible for any content, products, or services offered by third parties and disclaim any liability related to their use.

Our total liability for any claim shall not exceed the amount paid by you for the product or Service in question.

14. Indemnification

You agree to indemnify and hold harmless HomeHeatCentral, its affiliates, and employees from any claim, demand, or loss arising from your breach of these Terms or your violation of any law or third-party rights.

15. Severability

If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions shall remain valid to the fullest extent permitted by law.

16. Termination

These Terms remain in effect until terminated by either party. You may terminate them at any time by ceasing use of our Services. We may terminate your access at any time if we believe you have violated any term or condition.

17. Risk of Loss and Title

All orders are shipped F.O.B. origin, meaning ownership and responsibility for the product transfer to you once the shipment is accepted by the carrier. After that point, HomeHeatCentral is not liable for any loss, theft, or damage that occurs in transit.

You are responsible for inspecting all deliveries at the time of arrival. Any visible damage, shortage, or discrepancy must be noted on the delivery receipt before signing. Failure to do so may limit your eligibility for a replacement or freight claim.

If a shipment is lost or damaged in transit, we will assist in filing a claim with the carrier, but resolution and compensation are subject to the carrier’s claim process and approval.

18. Governing Law and Venue

These Terms and any related transactions shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota, unless resolved through arbitration as set forth below.

19. Dispute Resolution and Arbitration

We encourage you to contact us directly at support@homeheatcentral.com to resolve any disputes informally.
If an issue cannot be resolved within 30 days, you and HomeHeatCentral agree to resolve it through binding individual arbitration rather than in court, except that either party may bring a claim in small claims court.
Arbitration will be conducted under the rules of the American Arbitration Association (AAA). Each party will bear its own costs unless otherwise required by law.
You may opt out of this arbitration agreement by emailing support@homeheatcentral.com within 30 days of your first purchase.

This arbitration agreement does not apply where prohibited by law.

20. Entire Agreement

These Terms, along with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and HomeHeatCentral and supersede any prior agreements.
